Ashanti Region contested seats: Court upholds NDC’s motion for substituted service

The Kumasi High Court, in response to a suit filed by the National Democratic Congress (NDC), has granted a motion for substituted service following the party’s claim that they were denied additional victories in three constituencies within the Ashanti Region.

In the recent general elections, the NDC made significant gains in the Ashanti Region, increasing their seats from four to seven. The newly secured constituencies include Akrofuom, Adansi Asokwa, and Ahafo Ano South East, in addition to their existing strongholds in Asawase, Ejura Sekyedumase, Sekyere Afram Plains, and New Edubiase.

However, the party contends that they had won in three additional constituencies—Ahafo Ano North, Ahafo Ano South West, and Obuasi East— but were denied due to what they describe as unlawful declarations of results. To address this, the NDC is seeking a court injunction to overturn the outcomes in these constituencies.

The party initially faced challenges in serving the first and second respondents in their petition, prompting their legal team to file a motion for substituted service.

This allows the party’s legal team to serve the first and second respondents in their petition through alternative means as part of their efforts to secure an injunction on the disputed seats.

This move was necessary as the respondents were allegedly evading service, leading to the ex-parte application. The case has been adjourned to February 19, 2025, when the court is expected to hear the application for the injunction.

Evans Amankwah, a member of the NDC’s legal team, expressed confidence in the court process during an interaction with the media after the proceedings.

“We are going to paste copies of the processes at the designated areas that were stipulated in our motion for substituted service,” he said.

The NDC has urged its supporters to remain calm, assuring them of their faith in the legal system to resolve the matter.
