Srem-Sai: OSP declaring Ofori-Atta a fugitive too harsh

Dr. Justice Srem-Sai, a Senior Lecturer at the University of Ghana School of Law and Deputy Attorney General-designate, has criticized the Office of the Special Prosecutor (OSP) for declaring former Finance Minister Ken Ofori-Atta a fugitive.

He believes the OSP’s decision was overly harsh, emphasizing that declaring someone a fugitive is a serious matter.

 Dr Srem-Sai expressed concern over the legal and international implications of such a declaration, emphasizing its potential impact on Ofori-Atta’s rights and reputation.

He pointed out that such a designation could prompt international efforts to secure the individual’s return, restricting their freedom of movement and damaging their standing.

“Declaring someone a fugitive is a serious business. It is not a decision that should be taken lightly, as it has far-reaching consequences,” Dr Srem-Sai said during an interview on Joy FM.

The Deputy Attorney-General designate called on law enforcement agencies to approach high-profile investigations with caution.

“While accountability is crucial, we must ensure that legal procedures are strictly adhered to, avoiding actions that may appear arbitrary or unjust.”

Ofori-Atta, who has been in the United States for medical treatment since early 2025, reportedly informed both the former and current Chiefs of Staff about his absence.

On February 12, the Office of the Special Prosecutor (OSP) declared Ofori-Atta a suspect in four high-profile corruption investigations, including those related to the National Cathedral project and Strategic Mobilization Limited (SML).

Special Prosecutor Kissi Agyebeng also stated that the former minister was now a wanted person and must return immediately for questioning or face legal action.

The OSP’s decision has sparked widespread debate, with critics questioning whether due process was followed.

Some argue that the OSP should have pursued alternative legal avenues before taking such an extreme step.
