Supreme Court grants NDC’s request for substituted service on NPP MPs

The Supreme Court has upheld the National Democratic Congress’ (NDC) motion for NPP’s candidates in Techiman South, Ablekuma North, Okaikoi Central, and Tema Central not to be served personally.

This is after the NDc’s legal team on several occasions failed to serve the NPP respondents a certiorari application filed at the Supreme Court, seeking to overturn the High Court’s orders that allowed for collations to be completed in these constituencies.

Counsel for the NDC said in court on January 23 that attempts to serve the second to fifth interested parties [Patrick Boamah, Nana Akua Afriyie, Charles Forson, Martin Adjei Mensah Korsah] have remained futile as they have been evading service.

Hearing of the judicial review case has been obstructed by difficulty in serving the NPP candidates who are parties in the suit.

The NDC thus applied to the court for an order to allow for substituted service. This order waives the right of the candidates to be served personally and allows for service via other media.

The apex court granted the NDC’s plea and ordered for the application to be posted at the notice board at the supreme court.

The NPP candidates who are now MPs for Tema Central, Okaikoi North and Techiman South are to be served through the the legal department of parliament.

NPP parliamentary candidate for Ablekuma North Nana Akua Afriyie is to be served by posting the documents at NPP’s office at Odorkor.

Other media for service include posting it at a house in Tema belonging to Charles Forson and through the WhatsApp numbers of Charles Forson, Nana Akua Afriyie and Martin Adjei Mensah Korsah.

According to the court directive, the notice is to be posted for 14 days.
