The National Democratic Congress (NDC) together with five of its parliamentary candidates in the 2024 general elections have filed an exparte application against the Electoral Commission.
The applicants are praying the High Court to prevent the EC from re-collating and redeclaring the parliamentary results for Dome-Kwabenya, Okwaikwei Central, Ablekuma North, Tema Central and Obuasi East constituencies.
The applicants are Faustina Elikplim Akurugu (Dome-Kwabenya), Baba Sadiq (Okaikwei Central), Ewurabena Aubynn (Ablekuma North), Ebi Bright (Tema Central) and Samuel Aboagye (Obuasi East).
This comes after the EC declared the parliamentary results for Dome Kwabenya, Okaikwei Central, Ablekuma North, and Tema Central constituencies illegal and unable to be upheld because they did not follow due processes.
But the party and its candidates say the EC has no authority to re-collate and re-declare their results after declaring its candidates’ winners in the election.
They are therefore seeking an “order prohibiting the respondent from re-collating, re-counting and re-declaring the already collated and declared parliamentary election results in the Dome Kwabenya, Okaikwei Central, Ablekuma North, and Tema Central constituencies.”
“A declaration that by virtue of Article 99 of the 1992 constitution of the republic of Ghana and section 16 of PNDCL 284, it is the High Court of Ghana that has the exclusive original jurisdiction to invalidate the declaration of parliamentary election results and not the respondent.”
