Bernard Mornah’s disqualification appeal dismissed

The High Court has dismissed an application from Bernard Mornah, the flagbearer of the People’s National Convention (PNC), who sought to overturn the Electoral Commission’s (EC) decision to disqualify him from contesting in the upcoming presidential election.

The court’s ruling, delivered on Monday, October 21, 2024, leaves Mornah with no legal recourse to challenge his disqualification, complicating the PNC’s efforts as the December polls draw near.

Mornah’s disqualification stemmed from issues related to his nomination forms, which the EC deemed problematic during the vetting process.

Specifically, the EC cited errors and inconsistencies in the documentation submitted by Mornah, leading to their decision on September 20 to exclude him from the presidential race alongside ten other candidates.

The Commission stated that these issues were significant enough to warrant disqualification, prompting Mornah to seek legal intervention.

In his application, Mornah argued that the EC had overstepped its authority and failed to provide him an opportunity to rectify the errors in his nomination forms. He claimed that the Commission’s decision was unjust and undermined the democratic process.

However, the High Court upheld the EC’s ruling, reinforcing the Commission’s position and leaving Mornah without any further legal options.

The implications of this decision sparked significant discussions within Ghana’s political landscape, raising concerns about the fairness and transparency of the electoral process.
