The Member of Parliament for Ningo Prampram, Sam George, has accused Chief Justice Gertrude Torkornoo of intentionally delaying the transmission of the anti-LGBT bill to the President, stating that the CJ has become a cog in the wheel of justice.
On July 17, the Supreme Court deferred the ruling on the injunction applications by Dr Amanda Odoi and Broadcast Journalist, Richard Sky on the transmission of the anti-LGBTQ bill to the president and rather deliver the ruling on the same day the final judgement will be given.
The five-member panel, chaired by Chief Justice, Gertrude Torkornoo stated that the court agreed to make an early trial into the case as that will better serve the purpose of Justice.
Speaking on Eyewitness News with Umaru Sanda on Wednesday, July 31, 2024, Sam George said CHief Justice Torkornoo had no right under the Constitution of Ghana to pass such a ruling.
He explained that the chief justice’s ruling has intended to put an injunction on parliament.
“Only July 17, the Chief Justice came and said she will not or the court will to give its ruling on the injunction case which in effect if a judgement has been given, will determine if parliament could transmit the bill to the president in line with Article 106. She says she will not rule on it until she hears the substantive case.
“Effectively she is placing an injunction on parliament when she knows that as a Chief Justice, she has no such power and that she is acting in excess of her constitutionally mandated power. The Chief Justice has absolutely no power given to her by any part of the constitution of Ghana to seek to injunct a constitutional body like parliament and that is why she is hiding behind saying ‘I won’t give judgment in the injunction until I hear the who case, effectively injuncting parliament.
The Chief Justice of Ghana is becoming a cog in the wheel of justice and that cog will be taken out,” he stated.
