Ambulance case: Prosecution of Ato Forson incompetent, needless – Bright Simons

Bright Simons, the Vice President of IMANI-Africa, has expressed his disapproval of the legal proceedings against Minority Leader Dr Cassiel Ato Forson in the current ambulance procurement case, labeling the prosecution as “pointless” and lacking competence.

Dr Forson, who previously served as Deputy Finance Minister, along with two others, are facing charges for purportedly causing a financial detriment to the state by importing 30 ambulances.

The charges are linked to a 2012 agreement between the Ministry of Health and the Dubai-based company, Big Sea Limited, for the acquisition of the ambulances.

The prosecution alleges that Dr Forson created letters of credit without the necessary authorization from his superior at the time, Finance Minister Seth Terkper.

Contradicting this claim, Mr Terkper has given testimony in court affirming that he did, in fact, grant Dr Forson the authorization to issue the letters of credit.

Nevertheless, the trial persists, with Richard Jakpa, the third defendant, undergoing cross-examination at present.

Mr Simons has publicly shared his views on the issue via social media, making a post on X on Saturday, May 25.

He contends that the prosecution is a strategic move to suppress the voice of the Minority in Parliament.
Mr Simons maintains that letters of credit should be understood not as direct payments but as assurances to either fulfill or reject a payment contingent upon the satisfaction of specified conditions.

“I’ve racked my brains for eons & still can’t understand why this fact so obvious to every business person isn’t clear to Ghana’s Attorney General. The case against the Minority Leader in Ghana’s Parliament for authorising an LC is INCOMPETENT. Not just bcos of this MP’s point.”

“But more importantly because of what an LC is. An LC is not a simple instruction to pay. It is a guarantee to honor or REFUSE payment if CERTAIN CONDITIONS are met/NOT MET. This is a pure political prosecution to muzzle the opposition in Parliament. Luckily, it isn’t working,” he posted.
